James Harte contacted Redress Law for advice after his father’s death.
The two had seen very little of each other as the father had spent many of his later years living in France. Both men were born French, but had spent the majority of their years living in Britain. James had 3 siblings and was surprised and disappointed to discover that the will left everything to them.
However, when Redress investigated the matter we advised James that his father had in fact made provision for James in a former will. That will had been changed shortly before the father’s death.
Redress advised James that he had a claim for undue influence and lack of capacity of the father. This was on the basis that the brothers and sister had influenced the father to change his will when he was very close to death and lacking the capacity to make sound judgements.
The claim was successful and the estate was ordered to pay a substantial proportion to James in order to correct the irregularities.
