Adding insult to injury
I’m working on a number of cases involving personal injury solicitor negligence. Mostly, they have failed to either settle a case or issue the claim at court before the strict 3 year time limit, under the Limitation Act 1980.
It’s no wonder solicitors endure sleepless nights if they don’t keep a diary to remember these important deadlines! When solicitors miss a deadline, clients lose the opportunity to seek compensation from the wrong-doer, whether a careless driver in a road accident or an employer who has caused a work accident for example.
If you’re unable to pursue a personal injury claim due to solicitor’s negligence, all may not be lost since you may be able to sue your solicitor and have a second chance to be compensated.
You have 6 years to bring a professional negligence claim. The time starts running from the date the solicitor was negligent or if you were unaware that your solicitor had been negligent – it may have been concealed from you! - then you will have 6 years from the date of knowledge of the negligence.
Missing out on compensation
I’ve just been asked to help with a case involving personal injury solicitor negligence. My client had suffered a nasty injury to his knee after falling from a broken ladder at work. His knee was perfectly fine before the accident and despite having no end of treatment his knee just isn’t back to how it was. He’s really upset because he can’t play football anymore and he can’t walk for long periods at a time. I must admit I really felt for him because not only does he have to live with an injury as a result of his employer’s negligence but his solicitor had forgotten to issue court proceedings by the 3 year deadline leaving his claim out of time.
I’m now progressing a solicitor negligence claim against the personal injury solicitors for the solicitor’s mistake and pursuing the compensation my client ought to have received from his injury claim. Hopefully in the near future he will receive the compensation he deserves.
Limitation periods are very important. If your solicitor might have missed a deadline you should take advice as soon as possible to see if you can have a second chance to obtain solicitor negligence compensation.
